I'm not at all sure about the legitimacy of the email/correspondance (or even if it actually existed - it's a good way to get out of completing a project ) but it does remind us that sometimes we do take liberties with IP belonging to others.

It also reminds me that UK (and European) law does not offer a similar law to the U.S. "Fair Use." Now that IS criminal.

Kuron To be clear the thread you linked to is a lie. He has NOT been sued. He got a C&D and is being asked to pay part of the legal costs (not all of them).

I found the link via blitzbasic.com, the title says he was sued so I just reflected on that. He may not have been actually sued but he certainly received a bollocking nontheless.

You can't trademark or copyright a specific word like "Party", so you'd be perfectly safe. If the word you used was created/invented by a company, such as "Theatrhythm" by Konai, then it could be. Obviously caling your game "Mario's Penguin Party" might cause issues, but to be fair, Nintendo (and SEGA) have been very tolerant of fan projects.


King tried to sue games that contained the term "Saga" and initially looked like they got away with it, but in the end justice and common sense prevailed.

"Edge" (and any product containing "Edge") was a hot potato at one point thanks to Tim Langdell. Langdell eventually lost everything as a result of trying to sue everyone that used that word. That whole fiasco was fascinating reading as Langdell went from fairly sane (and intelligent) to completely stark raving fecking bonkers in no time flat.

That's great news Rockford, thanks for filling me in with the info on that.. Didn't KING also go for any game with "Candy" or "Crush" in the title also? Even games that were released before their infamous match-3 timewaster.
