Good games... Good games... Sonic 1 has been demolished on the Mastersystem, with all the chaos emeralds... Funny after all these years I still could remember where they were... I thought I'd played Sonic 2 on the master system, but firing it up... I realised I didnt... So, some work to do there!

Wrong. Emulation CAN be legal. As long as the the emulator BIOS is either legally released (as Amstrad has done with CPC and Spectrum etc.) or the BIOS is built from the ground up (some PS emulation for example) then you don't have a problem.

Indeed, Nintendo, Microsoft and Sony etc. all use emulators on their systems to play older games - eg the Virtual Console on Nintendo Wii/WiiU etc. This is perfectly legal.

Back-ups of your own software is a grey area, where people claim that because they own the software, they can use it in an emulator. Technically, this is still illegal, as most software is actually licensed for use, rather than owned, but hey ho. As far as I'm aware there are no cases where use of an emulator has lead to an arrest/fine/imprisonment.

Lots of IP owners have released their software for free or neglected it and not asked for removal (look on The World Of Spectrum fr example) for thousands of Spectrum "ROMs" (a misnomer for "games") that can be legally used in any Spectrum emulator. Not every Spectrum game is there - eg no "Ultimate Play The Game" titles (Knight Lore etc) as they refused to allow free distribution of their titles.

TOSECs (near complete sets of games for particular systems) are not legal either, but I doubt you'll find anyone that cares about retrogames gives a shit

However, the games mentioned above (Sonic etc.) - have never been made freely available by SEGA.

TBH, the only people likely to have any legal shit thrown at them are the people running that site. I don't expect it to be around for too long once SEGA's lawyers are made aware of it, but who knows, perhaps they'll turn a blind eye as these type of sites can encourage players to purchase the original games and sequels etc. I doubt it, but it's possible

Yeah, emulation itself is perfectly legal unless copyrighted software is required for it to run, bios etc.
As for backups, very very grey indeed. Legally the best you can do is back up your own games using your own equipment. This might still be technically illegal, but its far less illegal than downloading a game from the internet, regardless of you owning the physical disc/cart.
